A tenant's obligation to subordinate its lease to a mortgage on the property is satisfied when the tenant tenders a fully executed subordination agreement that is consistent with the other lease terms. The landlord bears the risk of loss due to a time delay resulting from negotiations to include additional terms in the subordination agreement or to amend the original lease. 2. To establish a claim for tortious interference with contractual relations or tortious interference with prospective economic relations there must be some evidence the alleged tortfeasor intentionally interfered with the contract or prospective relation.
